Under Texas Family Code Chapter 153, the best interest of the child is the court’s primary consideration when deciding conservatorship, possession, and access. Conservatorship describes the legal rights and duties parents have toward a child. Depending on the order, those rights may involve education, health care, support, consent to certain decisions, and access to school or medical information.

Managing conservatorship generally concerns parental rights and major decisions, while possessory conservatorship concerns possession of and access to the child. The order determines how those rights are allocated. Being named a joint managing conservator doesn’t automatically give each parent equal parenting time.

A standard possession order provides guideline terms for parenting time, but it isn’t the only possible arrangement. An order may also address holidays, exchanges, communication, and geographic restrictions on the child’s primary residence.
